The use of this Web attributes the condition of User of the same and expresses its full and unreserved acceptance of each and every one of the General Conditions published by the ESTA ESPAÑA ASSOCIATION, at the very moment in which you access the Web. , without prejudice to the acceptance of the particular conditions that may be applicable. Press images and videos may be used for editorial purposes. The rights of use and exploitation protected by copyright are the property of ASOCIACIÓN ESTA ESPAÑA, unless another owner is expressly indicated. Adding images to a file electronically/manually does not alter the validity to the fullest extent of all copyrights. The images used, modified, reproduced and/or altered electronically must include the indication of the source (©ESTA ESPAÑA). Its transfer to third parties for commercial purposes is prohibited –also in case of having been published electronically. The printing/publishing of the photographs is done free of charge. However, in the case of print media we request a copy of the publication and, if it is a video or electronic media, a short notice.

 

6.- Legality and correctness of the Contents included in the Web

The ASOCIACIÓN ESTA ESPAÑA does not guarantee nor is it responsible for any inaccuracy and/or lack of correction and/or lack of updating of the contents of the Web.

 

The responsibility of ASOCIACIÓN ESTA ESPAÑA regarding the content and information offered by Internet sites to which hyperlinks included in the Web lead, as well as those Contents from or from third parties that are hosted on the Web, will be governed by the provisions of the Articles 16 and 17 of the Information Society Services Law, Law 34/2002.

7.- Exclusion of guarantees and responsibilities

7.1.- ASOCIACIÓN ESTA ESPAÑA will only be responsible for its own services and contents directly originated by it and properly identified as industrial and intellectual property of ASOCIACIÓN ESTA ESPAÑA

 

7.2.- The ESTA ESPAÑA ASSOCIATION shall not be liable for:

 

7.2.1.- Damages that may arise from the provision or offer of products or services by third parties or entities through the Web, and in particular those derived from:

 

a) Failure to comply with the law, morality and public order, or the use of the products and/or services offered in a non-diligent or incorrect manner, or for illicit purposes or effects or contrary to what is established in these General Conditions or in the conditions that, where appropriate, are applicable.

 

b) Violation of industrial and intellectual property rights or business or professional secrecy. The commission of acts of unfair competition or illegal advertising.

 

c) Violation of the rights to honor, personal and family privacy and the image of individuals, and those relating to the protection of children and youth. The performance of acts of a pornographic nature.

 

d) The illegality or lack of veracity, accuracy, reliability, relevance, timeliness and completeness of the contents and information transmitted or made available to Users, including information and services provided by third parties or by Users through the Web.

The headings of the different clauses are for information only, and will not affect, qualify or expand the interpretation of the General Conditions.

 

In the event of a discrepancy between the provisions of these General Conditions and the particular conditions of each specific service, the provisions of the latter will prevail.

 

In the event that any provision of these General Conditions is considered null or inapplicable, in whole or in part, by any Court or competent administrative body, said nullity or non-application will not affect the other provisions of the General Conditions or the conditions individuals of the different services of the ESTA ESPAÑA ASSOCIATION.

 

The non-exercise or execution by ASOCIACIÓN ESTA ESPAÑA of any right or provision contained in these General Conditions will not constitute a waiver thereof, except for acknowledgment and agreement in writing on its part.

 

9.- Applicable law and jurisdiction

The provision of the Website service and these General Conditions of Use of the Website are governed by Spanish law. To the extent permitted by law, the parties, expressly waiving any other jurisdiction that may correspond to them, agree to submit to the jurisdiction of the Courts and Tribunals of the city of Madrid.
